Gaston Co. assistant DA arrested on drug charges

The Gaston County Assistant District Attorney was arrested on drug charges Sunday in Waxhaw.

UNION COUNTY, N.C. – The Gaston County Assistant District Attorney was arrested on drug charges Sunday in Waxhaw.

According to Waxhaw Police, James Brandon Graham, 47, was charged with felony possession of heroin and possession of methamphetamine, as well as possession of drug paraphernalia.

According to a Waxhaw Police incident report, officers pulled over Graham early Sunday morning for speeding and other traffic infractions.

Officers said they noticed a "loaded syringe with a brownish liquid in it located in the passenger seat with a tourniquet."

Police said they ultimately found six syringes containing heroin and three syringes testing positive for methamphetamine.

Investigators booked Graham into jail, but he bonded out.

Gaston County District Attorney Locke Bell declined NBC Charlotte's request for an interview, stating only that Graham will not be prosecuting any cases while these charges are pending.

According to the North Carolina Conference of District Attorneys' executive director, if Graham is convicted, defense attorneys could challenge his past convictions by filing a motion for appropriate relief, but it would have to go before a judge, and cases would only be decided on an individual basis.

Graham is scheduled to be in Union County court on May 17.
