It happened on East First Street late Monday night, around 11:40 p.m., according to the Newton Police Department.

Officers were responding to a 911 call at an apartment complex when they saw multiple "noncomplying" people in the parking lot. While officers were trying to find the person who called 911, they saw a man with a gun.

The North Carolina State Bureau of Investigations if looking into this incident, as is standard procedure.

This is the second time an officer in Newton has shot someone in the past two months. In May, police shot and killed a man who police said shot a woman multiple times and fired at first responders.
