Family of Fort Mill crossing guard sues school district months after he was hit, killed while on duty

The estate of Stanley Brucker claims the district was negligent in how it assigned crossing guards.

FORT MILL, S.C. — Just days after a crossing guard with the Fort Mill School District was hit by a car last week, the family of a crossing guard killed in March filed suit against the district.

The lawsuit was filed in York County's civil court on Oct. 18. The suit claims the district contracted with a company called Cross Safe to provide crossing guards at certain schools. However, the suit claims the district picked where crossing guards were assigned and knew or should have known some locations would be dangerous.

The lawsuit claims the district was negligent in its duty to the then-61-year-old Stanley Brucker to ensure he had a safe location at Fort Mill Elementary School to handle his duties, but failed to do so. The suit also named the South Carolina Department of Transportation as a defendant, although the suit did not list SCDOT in any of its four causes of action it sought.

Further, the lawsuit also names the driver who was involved in the collision as a defendant, claiming she wasn't driving safely at the time. The driver was not criminally charged after an investigation by both Fort Mill Police and the South Carolina Highway Patrol, and officials said the driver wasn't driving recklessly or dangerously.

Brucker's family is asking for a jury trial. If a ruling in her favor is awarded, she seeks damages, pre-judgement interest, for the defendants to pay the cost of the suit, and other relief deemed appropriate by the court.

Stanley Brucker's death caused tempers to flare in the wake of his death in March; crossing guards for the district refused to show up for two days after it was determined the driver who hit and killed him wouldn't face charges.

WCNC Charlotte has reached out to the district and SCDOT for comment. We've also asked for a response from Cross Safe. While they are not named as a defendant in the lawsuit, the suit notes Brucker was employed by the company.
