CHARLOTTE, N.C. — Amid allegations of a toxic work environment and a recording that caught Mecklenburg County Sheriff Garry McFadden using racially charged language, some people are calling on McFadden to step down.
McFadden has since apologized for the language he used but hasn't given any indication of leaving, saying he's still committed to the people of Mecklenburg County.
Should McFadden refuse to resign, some people are wondering if local lawmakers could step in and remove him from office. If so, how would that work?

Under North Carolina law, a sheriff can be removed from office for several reasons including being convicted of a felony or certain misdemeanors related to their official duties, engaging in misconduct that constitutes misbehavior in office or neglecting or refusing to perform their official duties.
The law states if there are grounds for removal, that would go through the judicial system rather than a decision by a county board of commissioners.
